1. ACCEPTANCE OF THESE TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your access to www.fireenginetours.com, your communications with San Francisco Fire Engine Tours & Adventures, LLC, and your purchase or participation in any tour, private charter, event, or related service offered by us.

In these Terms, “San Francisco Fire Engine Tours,” “Company,” “we,” “us,” and “our” refer to San Francisco Fire Engine Tours & Adventures, LLC. “Guest,” “customer,” “you,” and “your” refer to the individual making a reservation and every participant included in that reservation.

By accessing our website, making a reservation, purchasing a tour, or participating in one of our services, you acknowledge that you have read, understood, and agreed to these Terms.

If you make a reservation for other participants, you are responsible for providing them with these Terms and ensuring that they understand the applicable tour requirements.

2. OUR SERVICES

San Francisco Fire Engine Tours provides sightseeing tours, private charters, special-event transportation, bar crawls, photography opportunities, and other experiences using a vintage open-air fire engine.

Tour descriptions, routes, departure times, durations, prices, inclusions, and availability may vary by product and date. The details displayed on the applicable booking page and confirmation are part of your agreement with us.

References to particular landmarks, neighborhoods, routes, photo stops, equipment, clothing, or experiences describe the intended tour but do not guarantee that every feature will be available during every departure.

3. REZDY BOOKING SERVICES

We use Rezdy to display availability, accept reservations, process payments, issue booking confirmations, and manage modifications, cancellations, and refunds.

When you use a Rezdy booking page or widget, Rezdy and its payment service providers may collect and process information necessary to complete your reservation.

Rezdy provides the booking technology but is not the operator of the tour. San Francisco Fire Engine Tours & Adventures, LLC is responsible for operating the experience purchased directly from us.

4. ELIGIBILITY AND BOOKINGS FOR OTHER GUESTS

You must be at least 18 years old and legally capable of entering into a contract to make a reservation.

Children are welcome on eligible tours when accompanied by a parent, legal guardian, or responsible adult. The adult making the reservation accepts responsibility for supervising all minors included in the booking.

When making a reservation for another person, you represent that you have permission to provide their information and authority to accept these Terms on their behalf.

5. RESERVATIONS AND CONFIRMATION

A reservation is not confirmed until:

  • The required booking information has been submitted
  • The required payment has been successfully processed or another payment arrangement has been approved
  • A confirmation has been issued through Rezdy or directly by us

You are responsible for reviewing the confirmation immediately and notifying us of any incorrect tour date, departure time, guest count, contact information, or other reservation details.

Availability shown online may change until payment and confirmation are completed.

If your preferred date or time does not appear on the booking calendar, please contact us. We may be able to open an additional tour time, but availability is not guaranteed.

6. PRICES, FEES, AND PAYMENT

All prices are displayed and charged in United States dollars unless clearly stated otherwise.

The total price shown before purchase may include the tour price and any mandatory booking charges. Optional products, upgrades, gratuities, damage charges, overtime, and government-imposed taxes may be listed separately where permitted by law.

You authorize Rezdy, RezdyPay, or the applicable payment provider to charge the payment method submitted for the total amount displayed and accepted during checkout.

Prices and availability are subject to change before a reservation is confirmed. Once confirmed, the price will not ordinarily change unless you modify the reservation, add services, request overtime, or the original price resulted from an obvious technical or clerical error.

If an obvious pricing error occurs, we may cancel the affected reservation and issue a refund or offer you the opportunity to purchase the service at the correct price.

Promotional offers, discount codes, gift certificates, and special rates may have additional restrictions and may not be combined unless expressly stated.

7. CANCELLATIONS, RESCHEDULING, AND REFUNDS

Unless a different policy is clearly displayed for a particular product, private charter, promotional rate, or third-party booking, the following policy applies to direct Classic Tour reservations:

  • Cancellations received at least 48 hours before the scheduled departure time are eligible for a refund of the refundable amount paid.
  • Cancellations received less than 48 hours before departure are generally nonrefundable.
  • Guests who do not arrive, miss the departure, or arrive too late to participate are generally not eligible for a refund.
  • Rescheduling requests are subject to availability and are not guaranteed.

Approved refunds are generally returned to the original payment method. Payment-provider processing times may affect when the refund appears.

Reservations made through a travel agent, online marketplace, hotel concierge, reseller, or other third party may be governed by that party’s cancellation and refund policy. Guests who booked through a third party should contact that party directly.

Private charters and special events may have separate deposit, cancellation, rescheduling, and refund terms stated in the applicable proposal, invoice, or charter agreement. Those specific written terms control if they conflict with this section.

Nothing in this section limits any cancellation or refund right that cannot lawfully be limited.

8. WEATHER AND COMPANY CANCELLATIONS

Our vintage fire engine is open-air, and tours may be affected by rain, heavy wind, unsafe conditions, road closures, mechanical issues, government restrictions, or other circumstances.

We monitor operating conditions and may delay, modify, reschedule, or cancel a tour when we reasonably determine that doing so is necessary for safety or operations.

If we cancel a tour and cannot provide a reasonable replacement, affected customers will generally be offered the choice of rescheduling or receiving a refund of the amount paid directly to us for the canceled service.

We are not responsible for separate expenses such as transportation, parking, lodging, airfare, meals, or other travel arrangements resulting from a delayed, modified, or canceled tour.

9. ROUTES, STOPS, AND TOUR DURATION

Tour routes, landmarks, narration, stops, departure times, and durations are approximate and may change because of traffic, construction, closures, weather, law-enforcement activity, safety concerns, special events, or circumstances outside our control.

A particular route, view, landmark, neighborhood, or photo stop is not guaranteed.

We may substitute a reasonably comparable route or experience when necessary. A reasonable route modification does not automatically entitle a guest to a refund.

10. ARRIVAL AND DEPARTURE

Guests should arrive at least 20 to 30 minutes before the scheduled departure time unless their confirmation states otherwise.

The fire engine must depart on schedule. We may be unable to delay departure for late guests.

The meeting point, parking information, and arrival instructions included in your confirmation control over older descriptions or third-party listings.

Our passenger meeting point is not necessarily a staffed ticket office or secure storage facility. Guests should arrive with their booking confirmation and should not expect to purchase tickets or store luggage at the meeting point unless we have expressly confirmed otherwise.

11. GUEST CONDUCT AND SAFETY RULES

Guests must follow all reasonable instructions provided by the driver, guide, and other Company personnel.

While aboard the vehicle, guests must:

  • Use provided seatbelts or restraints as instructed
  • Remain seated while the vehicle is moving
  • Keep hands, arms, belongings, and other body parts inside the vehicle
  • Avoid blocking aisles, exits, or driver visibility
  • Supervise children at all times
  • Refrain from smoking or vaping
  • Avoid conduct that distracts the driver or creates a danger
  • Treat employees, other guests, members of the public, the vehicle, and visited locations respectfully

We may refuse service, deny boarding, or remove a guest whose conduct is unsafe, threatening, abusive, disruptive, unlawful, or likely to interfere with the experience of others.

A guest removed or denied participation because of their conduct may not be entitled to a refund.

12. OPEN-AIR AND VINTAGE VEHICLE CONDITIONS

Guests acknowledge that the experience takes place aboard a vintage open-air vehicle.

Conditions may include:

  • Wind, fog, sun, cold, heat, or rapidly changing weather
  • Road noise, horns, sirens, vibration, and sudden traffic movement
  • Steps, elevated seating, narrow boarding areas, and limited interior space
  • Exposure to ordinary roadway and vehicle movement

Guests should wear appropriate clothing and secure loose personal belongings.

Fire jackets, hats, or related items provided during the tour are offered for comfort, atmosphere, or entertainment. They are not represented as protective firefighting or safety equipment.

13. HEALTH, MOBILITY, AND ACCESSIBILITY

Guests are responsible for determining whether they can safely board, ride, and exit the vintage fire engine.

The vehicle is not equipped with a wheelchair lift and may not accommodate all wheelchairs, mobility devices, or accessibility needs. Guests with mobility concerns, medical conditions, sensory needs, or other accommodation requests should contact us before booking so that we can discuss available options.

We will make reasonable efforts to provide information and assistance, but not every accommodation may be possible because of the design and physical limitations of the historic vehicle.

Nothing in these Terms limits rights provided by applicable disability-access laws.

14. ASSUMPTION OF ORDINARY TOUR RISKS

Participation in an open-air vehicle tour involves ordinary and inherent risks, including boarding and exiting a vintage vehicle, road movement, traffic conditions, weather exposure, steps, uneven surfaces at stops, and interaction with public locations.

By participating, guests acknowledge these ordinary risks and agree to follow all safety instructions.

Nothing in these Terms releases or limits liability that cannot legally be released or limited, including liability arising from conduct for which a waiver is prohibited by applicable law.

15. ALCOHOL, BAR CRAWLS, AND INTOXICATION

Guests must be at least 21 years old to purchase or consume alcoholic beverages during an eligible private event or bar crawl and must carry valid government-issued identification.

Alcohol may not be consumed aboard the fire engine unless we have expressly authorized it and it is lawful under all applicable rules and permits.

Bar crawl participants generally purchase and consume alcohol at independently operated licensed establishments. Those businesses control their own admission, service, pricing, conduct, and alcohol policies.

We may deny boarding or remove a guest who appears dangerously intoxicated, behaves unsafely, threatens others, distracts the driver, damages property, or violates applicable law.

Guests remain responsible for their own alcohol consumption, conduct, transportation after the event, and compliance with the rules of third-party establishments.

16. PRIVATE CHARTERS AND SPECIAL EVENTS

Private charters, weddings, corporate events, birthday celebrations, bar crawls, photography sessions, and custom experiences may require a separate proposal, invoice, deposit, itinerary, or written agreement.

The applicable written agreement may establish:

  • Guest capacity
  • Route and schedule
  • Pickup and drop-off locations
  • Deposits and final-payment deadlines
  • Cancellation and rescheduling rules
  • Overtime charges
  • Cleaning or damage charges
  • Alcohol restrictions
  • Photography or production requirements
  • Additional insurance or permit requirements

If a signed charter agreement, proposal, or invoice conflicts with these general Terms, the more specific written agreement controls for that event.

17. PERSONAL BELONGINGS

Guests are responsible for their phones, cameras, bags, clothing, and other personal belongings.

Loose items should be secured before and during the tour. We are not responsible for property that is lost, left behind, damaged by weather, or dropped from the vehicle except to the extent responsibility cannot lawfully be excluded.

We do not guarantee secure luggage storage at the departure location or aboard the fire engine.

18. WEBSITE USE

You may use our website only for lawful personal or business purposes related to learning about, contacting, or booking our services.

You may not:

  • Attempt to gain unauthorized access to the website, booking system, accounts, servers, or networks
  • Introduce malware, harmful code, or automated attacks
  • Scrape, copy, reproduce, or exploit website content for unauthorized commercial use
  • Impersonate another person or submit false booking information
  • Interfere with website operation or another person’s use of the website
  • Use the website for fraudulent, abusive, threatening, or unlawful activity

We may restrict access or cancel fraudulent reservations when reasonably necessary to protect our customers, employees, service providers, or business.

19. INTELLECTUAL PROPERTY

The website and its original text, branding, logos, graphics, photographs, videos, designs, and other content are owned by or licensed to San Francisco Fire Engine Tours & Adventures, LLC and are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial purposes. No content may be reproduced, distributed, modified, sold, publicly displayed, or commercially exploited without prior written permission, except where permitted by law.

Third-party names, trademarks, photographs, and content remain the property of their respective owners.

20. THIRD-PARTY WEBSITES AND SERVICES

Our website may link to Rezdy, maps, social networks, review platforms, tourism partners, marketplaces, bars, restaurants, parking services, and other third-party websites or businesses.

We do not control and are not responsible for the availability, content, pricing, security, accessibility, conduct, or privacy practices of independent third parties.

A link or reference does not necessarily constitute an endorsement or guarantee.

Your use of a third-party website or service may be governed by separate terms and privacy policies.

21. DISCLAIMERS

We use reasonable efforts to provide accurate website, schedule, pricing, route, and availability information. However, information may occasionally contain errors, become outdated, or change without immediate notice.

To the fullest extent permitted by law, the website and services are provided on an “as available” basis. We do not guarantee uninterrupted website access, uninterrupted booking-system access, specific weather, unobstructed views, particular traffic conditions, or the availability of every advertised route or feature.

Nothing in these Terms excludes warranties, remedies, or protections that cannot lawfully be excluded under applicable consumer law.

22. LIMITATION OF LIABILITY

To the fullest extent permitted by law, San Francisco Fire Engine Tours & Adventures, LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from website use, a delayed or modified itinerary, third-party services, or circumstances outside our reasonable control.

Where liability may lawfully be limited, our aggregate liability arising from a particular reservation will not exceed the amount paid directly to us for the affected reservation.

These limitations do not apply to liability that cannot legally be excluded or limited.

23. RESPONSIBILITY FOR DAMAGE AND LOSSES

Guests may be responsible for reasonable costs resulting from damage to the vehicle, equipment, property, or third-party locations caused by their intentional misconduct, unlawful conduct, or failure to follow safety instructions.

The person who books a private charter may be responsible for charges authorized in the applicable charter agreement, including overtime, extraordinary cleaning, or guest-caused damage.

24. EVENTS OUTSIDE OUR CONTROL

We are not responsible for a failure or delay caused by events beyond our reasonable control, including severe weather, natural disasters, fire, mechanical emergencies, road or bridge closures, government orders, public emergencies, labor disruptions, utility failures, Internet outages, transportation interruptions, or similar events.

When reasonably possible, we will attempt to communicate significant changes and offer an appropriate rescheduling or refund option consistent with these Terms and applicable law.

25. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Before filing a legal claim, you and the Company agree to make a reasonable good-faith effort to resolve the dispute informally by contacting the other party and allowing a reasonable opportunity to respond.

Unless applicable law requires otherwise, legal proceedings arising from these Terms or services provided directly by us will be brought in a court of competent jurisdiction located in the City and County of San Francisco, California.

Nothing in this section prevents either party from pursuing a claim in small-claims court when eligible or exercising a right that cannot legally be waived.

26. SEVERABILITY AND NO WAIVER

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or removed without affecting the remaining provisions.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

27. ENTIRE AGREEMENT

These Terms, the applicable booking page, confirmation, Privacy Policy, and any signed private-charter agreement constitute the agreement between you and us concerning the applicable service.

If a specific signed charter agreement or written offer conflicts with these general Terms, the more specific written terms control for that reservation.

28. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our services, booking system, pricing, business practices, or legal obligations.

The updated Terms become effective when posted unless a later date is stated. The “Last Updated” date will identify the most recent revision.

The Terms in effect when a reservation was confirmed will generally govern that reservation unless a change is legally required or agreed to by the parties.
